Consultation on the structure, independence, powers, resourcing and other matters relating to the new specialist division was conducted by the Honourable Murray Wilcox QC, who provided his report to the Government on 31 March 2009.
The consultation process has now closed.
On 3 April 2009 the Minister for Employment and Workplace Relations, The Hon Julia Gillard MP, released the Hon Justice Murray Wilcox QC's report into the transition to Fair Work Australia for the building and construction industry.

Murray Rutledge Wilcox QC is a former Australian Federal Court Judge, serving from May 1984 until retiring in October 2006. He also served as the Chief Justice of the Industrial Relations Court of Australia.
Building and Construction Industry Improvement Amendment (Transition to Fair Work) Bill 2009
The Minister for Employment & Workplace Relations, the Hon Julia Gillard MP introduced the ‘Building and Construction Industry Improvement Amendment (Transition to Fair Work) Bill 2009’ into the Australian Parliament.
The Bill represents the Australian Government’s response to the report provided by the Hon Murray Wilcox QC on the ‘Transition to Fair Work Australia for the Building and Construction Industry’ and meets the Governments election commitments outlined in the ‘Forward with Fairness, Policy Implementation Plan'.
