The Code Monitoring Group (CMG) deals with Code issues, including alleged breaches and sanctions. It consists of senior representatives from a number of Australian Government agencies who hold an interest in the Code and Guidelines.
The CMG is advised of alleged breaches of the Code and Guidelines by voluntary reporting from agencies or companies, and through audits and investigations by the ABCC.
The CMG determines whether breaches of the Code and Guidelines have occurred and makes recommendations whether breaches of the Code and Guidelines have occurred and makes recommendations to the Minister for Education, Employment and Workplace Relations about whether a sanction should be imposed on a party for a breach of the Code and Guidelines.
The CMG is required to follow the Procedural steps for each version of the Guidelines which are outlined in the document:
- Procedural steps for considering breaches of the National Code of Practice for the Construction Industry and the Australian Government Implementation Guidelines, August 2009
