Secretary's guidelines for special circumstances for remission of HEC/PELS/BOTP semester debts/OL study period debt for units of study commenced on or after 1 January 1998

Under sub-section 106L(3A) of the Higher Education Funding Act 1988 (HEFA), the Secretary may issue Guidelines outlining in what circumstances the Secretary or his or her delegate will be satisfied of the matters contained in section 106L of HEFA.  The Guidelines set out the legislative basis for the circumstances which are to be considered special circumstances. 

The Secretary of DEST (now DEEWR) has delegated her power under HEFA to allow higher education providers to consider the remission of HEC, PELS, BOTP semester debts and OL study period debts incurred before 2005.  These guidelines are to be used by higher education providers when considering the remission of such debts. 

Debts incurred from 1 January 2005 are remitted under the Higher Education Support Act 2003, under provisions contained in the Student Learning Entitlement Guidelines.
